GRAND RAPIDS, MI (AP)— A judge in Michigan has cleared the way for a civil trial in the 2022 death of a Black man who was shot in the back of the head by police.
Lawyers for Christopher Schurr argued that he was entitled to immunity in the lawsuit. They claim the use of force against Patrick Lyoya was "objectively reasonable.” Federal Judge Paul Maloney wasn't swayed. He says a jury will sort it out.
Schurr was separately charged with second-degree murder, but the case was dropped after a jury couldn't reach a verdict. He was a police officer in Grand Rapids.
