UP man charged with embezzling from elderly woman

MACOMB COUNTY, MI— An Ontonagon man has been charged with embezzling from an elderly downstate woman.

Attorney General Dana Nessel’s office says 61-year-old Richard Filbey is accused of stealing more than $275,000 from the woman while acting as her power of attorney. He was charged last week with embezzlement from a vulnerable adult, $20,000 to $50,000, embezzlement from a vulnerable adult, $100,000 or more, ‘embezzlement by an agent of $20,000 to $50,000, and two counts of making/permitting the filing of false tax returns.

Filbey began acting as power of attorney for the 86-year-old woman in 2018. He’s accused of causing her to surrender two of her annuities and of selling property she owned in Lapeer. He allegedly used all the proceeds for himself.

None of the funds were reported by Filbey as income on his Michigan tax returns.

Nicole was born near Detroit but has lived in the U.P. most of her life. She graduated from Marquette Senior High School and attended Michigan State and Northern Michigan Universities, graduating from NMU in 1993 with a degree in English.
