Driver who hits, kills Iron County flagger charged

CRYSTAL FALLS, MI--   A Wisconsin man has been charged in the death of an Iron County Road Commission flagger in January.

The Iron County Reporter says Jerry Mittelstadt, 57, of Argonne, Wisconsin faces one count of moving violation—causing death in a work zone and/or driving causing death. Both are felonies punishable by up to 15 years in prison.

Mittelstadt was also charged with being a third offender. He was convicted of operating while intoxicated in Wisconsin in 2001 and 2006. The habitual offender notice could double the maximum sentence.

Mittelstadt is accused of failing to stop in a marked work zone in Bates Township in January. He hit a flagger, pinning him between his truck and a Road Commission vehicle. The flagger died at the scene.

A preliminary exam is set for July 19 in Iron County District Court.
