Smith pleads not guilty in Volp death

MARINETTE, WI--   A man accused of killing Iron Mountain resident Eric Volp in 2008 has waived his preliminary hearing in Marinette County.  

Erik Smith, 33, is charged with first-degree homicide, homicide by negligent operation of a vehicle, hiding a corpse, and hit and run involving death.  He’s accused of hitting Volp with his car following an argument, then putting Volp’s body in the trunk of his car and dumping it in a stream near Dunbar, Wisconsin.

Smith—who is serving time in a Colorado prison on child pornography charges—appeared in court through a video link. 

A motions hearing is set for May 27. 

Nicole was born near Detroit but has lived in the U.P. most of her life. She graduated from Marquette Senior High School and attended Michigan State and Northern Michigan Universities, graduating from NMU in 1993 with a degree in English.
