Judge denies Delta County commissioners' appeal of recall language

ESCANABA, MI— Those behind the recall of three Delta County commissioners can start to collect signatures to put the issue on the May ballot.

The Delta County Citizens for Ethical Leadership filed the recall against Robert Petersen, David Moyle, and Robert Barron for the firing of County Administrator Emily DeSalvo.

All three commissioners appealed, but Circuit Court Judge Christopher Ninomiya rejected the appeal Monday, calling it “frivolous.”

The hearing was held three days after an August 4th deadline to submit signatures to put the issue on the November ballot. Recall organizers are now targeting the May election.

Ninomiya presides over Dickinson, Iron, and Menominee counties. He heard the appeal because the commissioners have a role as part of the funding unit for Delta County Circuit Court, creating a conflict for Judge John Economopoulos.
