Marquette cheesecake lawsuit fails

MARQUETTE, MI (AP)--   The Michigan appeals court has a message for an Upper Peninsula woman who was injured while carrying a slice of cheesecake, and it's not as sweet as the dessert. 

The court says Bonnie Campbell has no cause of action against the Holiday Inn in Marquette. She fell after tripping on a serving tray that was extended into an area where diners walked.

Campbell says she wasn't looking down because she was carrying a slice of cheesecake and a beverage. She says, "The next thing I knew I was flying in the air."

The court says the obstacle should have been "open and obvious" to Campbell as she was enjoying Sunday brunch at the hotel.

The court upheld a decision by a Marquette County judge dismissing the case.

Nicole was born near Detroit but has lived in the U.P. most of her life. She graduated from Marquette Senior High School and attended Michigan State and Northern Michigan Universities, graduating from NMU in 1993 with a degree in English.
